In California, filing for an annulment involves a few steps. If you believe your marriage or domestic partnership is legally void or voidable, here’s a general outline of the process:
Application Process for an Annulment:
1. **Understand Ground for Annulment**: First, ensure that you have valid grounds for annulment. In California, reasons include:
- Incest: The partners are close blood relatives.
- Bigamy: One partner is already married or in a domestic partnership.
- Underage: One partner was under 18 at the time of marriage or domestic partnership.
- Unsound Mind: One partner was of unsound mind or unable to understand the nature of marriage or domestic partnership.
- Fraud: The marriage or partnership was entered into by deceit.
- Force: One partner was forced into the marriage or partnership.
- Physical Incapacity: One partner was physically incapable of consummating the relationship, and the incapacity continues and appears incurable.
2. **File the Petition**: Complete and file Form FL-100 (Petition – Marriage/Domestic Partnership) and Form FL-110 (Summons) at the local courthouse in the county where you live.
3. **Serve Your Spouse**: Your spouse or domestic partner must be formally served with copies of the annulment papers. This can be done by someone who is at least 18 years old and not a party to the case. They must complete and file a Proof of Service of Summons (Form FL-115).
4. **Response**: Your spouse/domestic partner has 30 days to file a response (Form FL-120). If they agree with the annulment, the process can proceed without a trial. If they contest, a court hearing will be necessary.
5. **Financial Disclosures**: Both parties must complete and exchange Preliminary Declarations of Disclosure (Form FL-140, FL-142, and FL-150).
Filing Process for the Annulment:
1. **File Additional Forms**: Depending on your situation, you might have to file additional forms such as Request for Order (Form FL-300) if you need temporary orders for child custody, support, etc.
2. **Court Hearing**: If the annulment is contested, a court hearing will be scheduled. You will present your evidence and possibly witnesses to support your grounds for annulment. The judge will make a decision based on the evidence and testimonies.
3. **Judgment**: If the judge grants the annulment, they will sign a Judgment of Nullity (Form FL-180). This legally annuls the marriage or partnership, as if it never happened.
4. **Final Documentation**: File the Notice of Entry of Judgment (Form FL-190) and ensure all court orders are complied with, such as child support or custody arrangements.
